Acceptance of Terms
By downloading, installing, accessing, or using the Swayu mobile application or website (collectively, "the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree, you must not access or use the Service. We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the revised terms.
Health & Medical Disclaimer
Swayu is a wellness and health companion powered by artificial intelligence. It is NOT a medical device, and does NOT provide medical advice, diagnosis, or treatment. The information provided by Swayu, including nutritional insights, health patterns, and proactive check-ins, is for general informational and wellness purposes only. It should not be used as a substitute for professional medical advice. Always consult a qualified healthcare provider before making changes to your diet, exercise, or health routine. If you are experiencing a medical emergency, contact your local emergency services immediately. Swayu does not claim to treat, cure, or prevent any disease or medical condition, including but not limited to PCOS, diabetes, thyroid disorders, or any other health condition.
Eligibility
You must be at least 13 years of age to use Swayu. If you are between 13 and 18, you may only use the Service with the consent of a parent or legal guardian. By using Swayu, you represent and warrant that you meet these age requirements. We do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will delete it promptly.
Account Registration
To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Use of Service
You agree to use Swayu only for lawful purposes and in accordance with these Terms. As a voice-first health companion, Swayu relies on the accuracy of your voice inputs and text entries. You agree not to: (a) use the Service for any unlawful purpose; (b) impersonate any person or entity; (c) attempt to gain unauthorized access to the Service or its systems; (d) use the Service to transmit harmful, offensive, or misleading content; (e) reverse engineer, decompile, or disassemble any part of the Service; (f) use automated systems to access the Service without our permission.
Subscriptions & Payments
Swayu may offer free and paid subscription plans. If you purchase a subscription: (a) payment will be charged to your Apple ID or Google Play account at confirmation of purchase; (b) subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period; (c) your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan; (d) you can manage and cancel subscriptions in your device's account settings. Refunds are handled according to Apple App Store or Google Play Store policies. Founding 100 members receive lifetime pricing as specified at the time of enrollment.
Voice & AI Features
Swayu uses voice recognition and artificial intelligence to process your health inputs and provide personalized insights. Voice recordings are processed to extract health-relevant information and are not stored permanently in raw audio form. AI-generated insights are based on patterns in your data and general nutritional knowledge. They should not be treated as professional medical or dietary advice. The accuracy of AI responses depends on the quality and completeness of the information you provide.
User Content & Data Ownership
You retain ownership of all personal data and content you provide to Swayu. By using the Service, you grant Swayu a limited, non-exclusive license to process your data solely for the purpose of providing and improving the Service. We will never sell your personal health data to third parties. You may request export or deletion of your data at any time through the app settings or by contacting us.
Intellectual Property
The Swayu name, logo, visual design, AI models, algorithms, and all content provided through the Service are the exclusive property of Swayu and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.
Third-Party Services
Swayu may integrate with or contain links to third-party services, including but not limited to payment processors, analytics providers, and cloud infrastructure. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is governed by their respective terms and policies.
Limitation of Liability
To the maximum extent permitted by applicable law, Swayu and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health outcomes, or profits, arising from your use of or inability to use the Service. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.
Indemnification
You agree to indemnify and hold harmless Swayu, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time. Sections relating to intellectual property, limitation of liability, indemnification, and governing law shall survive termination.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or via email. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
